Queensland Government- Department of Education – Draft and Review a Services Agreement (boarding and facilities management service contract) and Lease

Property

Related to the construction and operation of boarding facilities in a remote area. The matter had a number of unique obstacles due to the remoteness of the boarding school and required on the ground understanding and a community-oriented lens coupled with property and commercial law expertise.  Marrawah Law provided legal advice during the negotiations and attended a number of negotiation sessions over a 6 month period. We completed a final review of the agreement and lease prior to execution by the client, which included a letter of advice summarising the key legal risks and issues in the agreement and lease.  The advice included a position on: liability, indemnity, intellectual property, rights to suspend or exit the arrangement, payment structure and other matters we considered prudent to brief the Department’s senior management.
